What's Included
Trade Mark protection can be a complex process where you can encounter technical legal difficulties. We have tried to explain the filing process in simple terms, but we understand that you may have more questions about what is involved. If so, call us today for a free 15 minute consultation with one of our Trade Mark Attorneys.
①
Brand Protection Strategy
We will provide you with a comprehensive document bespoke to your business that will -
- Explain why trade mark protection is important.
- Outline the stages of the application process.
- Provide a bespoke detailed list and explanation of the recommended classes that you will need to cover in order to have the best protection possible.
- Advise on whether your trade mark is actually registrable from a legal perspective.
- Give you a clear search report outlining the identical and very obvious highly similar marks that might stand in your way.
- Recommend filing strategy to ensure and guarantee that your application passes the examination stage.
- Breakdown the costs of the application.
- Tell you what the next steps are so that you can begin the process of protecting your trade mark.
We provide the Brand Protection Strategy at a cost of £200+VAT for one trade mark application and £50+VAT for each additional application.
②
EU Search
Our strategy team will conduct a brief and cursory search for identical and very obvious highly similar marks that might conflict with your application in the classes that you need to cover. This will allow you to see how unique your trade mark is. It will also give you an indication as to whether there are any high-risk obstacles that could stand in the way of your application.
You are always welcome to speak to one of our Trade Mark Experts about the results.
*This is not a substitute for a full clearance search.
③
Registrability Advice
According to European Trade Mark law, trade marks cannot be registered if they are non-distinctive, describe characteristics of your goods and services, or contain common and generic terms which are used in your trade and industry.
We will advise you on whether your trade mark is actually registrable and recommend a protection strategy which will guarantee that the application is accepted by the examiner at the EUIPO Office.
④
Drafting Specification of Goods and Services
When you protect a trade mark, it must cover specific goods and services. Our Strategy Team will prepare a comprehensive and detailed list of goods and services that you should include in your application to have the best protection possible.
We always aim to provide you with the broadest and strongest protection so that no other businesses can copy your name, take advantage of your reputation, or tarnish your brand.
⑤
Preparing Application
Once we have all of your information, answered your questions, you have agreed with our strategy and classes to cover, and we have drafted your specification, we can then prepare the application for your approval and make any necessary changes.
⑥
Filing Application
Once you confirm that you are happy with everything we will simply arrange for your trade mark application to be submitted at the EUIPO.
Your journey to EU trade mark protection will officially begin!
⑦
Reporting All Stages
For EU applications, we will report all stages of the application process to you, which include filing the application, examination reports that require your instructions, publication of the application and the opposition period, the priority period, registration and renewal deadlines.
If there are any challenges made by third parties, we will also bring these to your attention.
⑧
Trade Mark Monitoring (Optional)
