Fees

EU Unlimited Fees Explained.

Our professional fees are a fixed £350 + VAT, for an unlimited number of Classes. In addition to this you will need to pay the EUIPO's official filing fees which are;

£750 + VAT for the 1st Class, £50 + VAT for the second class and £150 + VAT for each additional class.

The EUIPO's filing fees are actually paid in Euros so there may be a small difference depending on the exchange rate fluctuations at the time of filing. We will inform you of any shortfalls prior to your application.

What's Included

Trade Mark protection can be a complex process where you can encounter technical legal difficulties. We have tried to explain the filing process in simple terms, but we understand that you may have more questions about what is involved. If so, just ring our office and speak to an expert – we are happy to answer any queries!

1

Protection Strategy

We will provide you with a comprehensive document bespoke to your business that will:-

  • Explain why trade mark protection is important.
  • Outline the stages of the application process.
  • Provide a bespoke detailed list and explanation of the recommended Classes that you will need to cover in order to have the best protection possible.
  • Advise on whether your trade mark is actually registrable from a legal perspective.
  • Give you a clear search report outlining the number of identical marks that might stand in your way.
  • Recommend filing strategy to ensure and guarantee that your application passes the examination stage.
  • Breakdown the costs of the application.
  • Tell you what the next steps are so that you can begin the process of protecting your trade mark.
2

Cursory Search

We will conduct a Regional Identical Screening Search in the national EU registries, as well as the EU IPO for any identical matches of your trade mark and provide you with the statistical data needed to see whether your trade mark has been applied for, or protected in the EU, by a third party.

This search is important because your EU application can be objected to by owners of earlier conflicting trade mark registrations in any EU member state.

After the breakdown of the statistical information, if you require more in-depth searching, we will include the cost of retrieving the data, reviewing and analysing the results, drafting a report, advising on the marks and categorising the risks.

3

Registrability Advice

According to European Trade Mark law, trade marks cannot be registered if they are non-distinctive, describe characteristics or your goods and services, or contain common and generic terms which are used in your trade and industry.

We will advise you on whether your trade mark is actually registrable and recommend a protection strategy which will guarantee that the application is accepted by the examiner at the EU IPO.

4

Drafting Specification of Goods and Services

When you protect a trade mark, it must cover specific goods and services. Our Specification Team will prepare a comprehensive and detailed list of goods and services that you should include in your application to have the best protection possible.

We always aim to provide you with the broadest and strongest protection so that no other businesses can copy your name, take advantage of your reputation, or tarnish your brand.

5

Unlimited Classes

There are up to 45 different classes of goods and services that a trade mark can be protected for. Our flat-fee policy of £350+VAT means that you can include as many Classes of goods and services in your application for that price. The only other cost will be the official EU IPO fees, which increase for each Class you wish to protect.

This means that you can apply for the best protection possible, confidently knowing that, unlike our competitors, our fees will never increase over £350+VAT, regardless of how many classes you choose. We encourage our clients to shop around with our competitors, who mostly increase their own professional fees when clients apply for more Classes.

6

Preparing Application

Once we have all of your information, answered your questions, you have agreed with our strategy and Classes to cover, and we have drafted your specification, we can then prepare the application for your approval and make any necessary changes.

7

Filing Application

Once you confirm that you are happy with everything we will simply submit your trade mark application to the EU IPO.

Your journey to trade mark protection will begin!
